1. Acceptance of Terms & Nature of Service

Welcome to Sansthit. By accessing our website, platform, software, and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our Service.

Sansthit is strictly a Software as a Service (SaaS) provider. We provide digital tools for community management, donation tracking, and event pass generation. We are not a bank, financial institution, fiduciary, trustee, or a registered NGO. We do not intermediate, touch, or hold community funds at any point.

2. Financial Compliance and Zero Commission UPI

Regarding financial tracking and direct UPI payments facilitated through the Service:

• Direct Transfers: Sansthit facilitates Peer-to-Peer (P2P) or Peer-to-Merchant (P2M) UPI transfers directly to the community's linked bank account. We charge 0% commission on these transfers.
• Regulatory Responsibility: The registered community/Samiti is solely responsible for its own tax compliance, income tax filings (including 12A/80G compliance in India), and FCRA norms (if accepting foreign funds).
• Receipts: System-generated receipts are for record-keeping purposes only. It is the community administrator's responsibility to ensure these receipts meet local tax exemption laws.

3. Data Privacy and Information Security

Sansthit operates in compliance with standard data protection guidelines, acting as a Data Processor while the registered community acts as the Data Controller.

• Consent: Community administrators warrant that they have explicit consent from their members to digitize and store their personal data (Name, Phone, UTR details) on our platform.
• Data Protection: We use industry-standard encryption to protect user data. Sansthit strictly strictly prohibits selling, renting, or leasing community data to third-party marketing agencies.
• Data Retention: Upon account termination, users have a 15-day grace period to export records, after which data is permanently purged from our servers.

4. Account Security and Prohibited Activities

To ensure a safe environment, users must adhere to the following rules:

• Administrators must provide accurate legal names and registration details of their Samiti/Organization. Fake or impersonated accounts will be terminated immediately.
• You are responsible for safeguarding your login credentials. Sansthit is not liable for unauthorized access resulting from user negligence.
• Prohibited Use: You may not use the Service for money laundering, terrorism financing, fraudulent collections, transmitting offensive/communal content, or distributing malware.

5. Intellectual Property Rights (IPR)

The Service, including its original source code, logic, UI/UX design, algorithms, logos, and graphics, are the exclusive intellectual property of Sansthit and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform. You may not copy, reverse engineer, or create derivative works from the Sansthit platform.

6. Subscriptions, Payments, and Refund Policy

Access to premium features of Sansthit may require a paid subscription.

• Subscription fees are billed in advance on a recurring basis.
• No Refunds: Unless mandated by consumer protection laws, subscription payments are non-refundable, including for partial months of service.
• We reserve the right to change our pricing structure with a 30-day electronic notice to active users.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Sansthit, its founders, directors, employees, or affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to the use of, or inability to use, the service.

Sansthit assumes no liability for failed UPI transactions, banking network downtime, or disputes arising between community administrators and their devotees/donors.

8. Indemnification

You agree to defend, indemnify, and hold harmless Sansthit and its employees from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any copyright or privacy right.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, specifically adhering to the Information Technology Act, 2000 and IT Rules, 2021.

Any disputes or legal proceedings arising out of or in connection with the use of Sansthit shall be subject to the exclusive jurisdiction of the competent courts located in Sitamarhi, Bihar, India.
